Terms and Conditions

www.hiapp.co.in is the official website for HiApp Technologies that provides personalized business management solutions to its customers in the National Capital Region (NCR). HiApp offers services to the B2B segment; no direct users are involved in this. The User must be someone (employee/owner/member) from the client, whom HiApp has an agreement with.

HiApp and its services are subject to your agreement with the Terms and Conditions mentioned below. Please carefully read the following terms and conditions before you start using the site:

Accessing our Site

• You must provide a full legal name, address, a valid email address and other information requested in order to the complete the sign-up procedure.
• If you make the services available to the entire or a part of the organization (including your employees), you must ensure that each User complies with the Terms and Conditions and, acknowledge that you would be responsible and liable for all the acts and omissions made by each User to the same extent as if you had carried such acts/omissions yourself.
• If you register with HiApp, then you will be issued a username and password to access your account. You must treat this information as confidential and must not disclose it to a third party. HiApp reserves the right to disable your account, if we feel that you have not complied with the Terms of Use.
• You would be responsible for the privacy and security of your account. HiApp will not be responsible for any damage or loss of information that may result from your inability to secure your login information, including your account password.
• HiApp would communicate with you via email or phone regarding any information/issues related to your account.
• You are responsible for all the activity and the content that has been posted to your account, even if it has been posted by others. HiApp may refuse service to anyone for any reason at any time if we feel that it is not in our best interests.

Payment and Trial Period

• There are two types of costs involved – "Setup Cost" and "Customization Cost". Setup Cost is the initial cost, which every client has to pay while Customization Cost only incur to those clients who want personalized settings in the software.
• HiApp will charge you an annual fee based on your account plan. Once the software setup is complete, the client has to pay the annual subscription fees for each user in advance.
• HiApp also enables users to register for a free 30 day trial period. However, once the software is customized, there is no trial period.
• If you upgrade your account from a free account to a fee paying account, then there is no trial period. You will be charged immediately following any upgrade.

General Conditions

• You assume total responsibility and risk for all the content and information uploaded on the software, and for the use of this service.
• You agree not to duplicate, resell, exploit or reproduce any part of the software without written permission of HiApp.
• You may not use the software to store, host or send unsolicited (spam) email or text messages.
• HiApp will use any commercially acceptable physical, administrative and technical safeguards to provide security, integrity and confidentiality of your data.
• HiApp gives no warranties related to:
1. Your ability to use the software,
2. Your satisfaction with the software,
3. That the software will be available at all times, unbroken or error-free,
4. The accuracy of the calculations provided by the software and
5. That Bugs and errors will always be corrected in the software
• If any provision under the Terms and Conditions is held invalid or unenforceable, all the other remaining provisions will however, be enforceable and not be impaired thereby.
• HiApp reserves the right to remove any content or information that we feel in our sole discretion is offensive, unlawful, libelous, threatening, obscene, slanderous or otherwise violating the Terms and Conditions or any other party's intellectual property.

Viruses, Hacking and other Offences

• You must not misuse our software by knowingly or unknowingly introducing Trojans, viruses, logic bombs, worms or any other material, which is malevolent or technologically harmful to the site.
• You must not attempt to gain unauthorized admission to our site, to the server in which our site is stored or any database, server that is connected to our site.
• You must not attempt to make a distributed denial-of-service attack or a denial-of-service attack to our site.
• By breaching any of the above provisions, the activity will be considered as a criminal offense and legal action will be undertaken.
• HiApp is not responsible for any loss of content or information due to viruses, distributed denial-of-service attacks and other harmful materials that may infect your computer equipment, programs or data.

HiApp reserves the right to change, modify and update the Terms and Conditions at any time by informing the registered users. Should you continue to use the services after any such modifications, this shall constitute as your agreement to the changes. Violation of any part of the Terms and Conditions will lead to direct termination of your account.
